1. Acceptance of Terms

By downloading, installing, or using the SoBoard mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and SoBoard ("we," "our," or "us") regarding your use of the App and related services.

2. Description of Service

SoBoard is a social media analytics and management application that allows users to:

• Connect and manage multiple social media accounts
• Track follower growth and engagement metrics
• Analyze content performance across platforms
• Generate reports and insights
• Monitor social media trends and statistics

The App integrates with various social media platforms including but not limited to Twitter, Instagram, YouTube, TikTok, Facebook, Snapchat, Discord, Twitch, and Reddit.

3. User Accounts and Registration

To use certain features of the App, you may need to:

• Create an account or connect existing social media accounts
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent.

4. Acceptable Use Policy

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App for any illegal or unauthorized purpose
• Violate any applicable laws or regulations

5. Social Media Platform Integration

• Understand that platform changes may affect App functionality
• Can disconnect accounts at any time
• Are responsible for maintaining valid platform credentials

We are not responsible for any changes made by social media platforms that may affect the App's functionality.

6. Data and Privacy

Your privacy is important to us. Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you acknowledge that:

You are granted a limited, non-exclusive, non-transferable license to use the App for personal or commercial purposes, subject to these Terms.

You may not copy, modify, distribute, sell, or create derivative works based on the App without our express written consent.

8. Disclaimers and Limitations

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the App will be uninterrupted or error-free
• Warranties regarding the accuracy of analytics or insights
• Warranties that defects will be corrected
• Warranties regarding third-party platform integrations

We are not responsible for any decisions made based on the App's analytics or insights.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOBOARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Damages resulting from social media account issues
• Losses due to platform changes or API limitations
• Damages from unauthorized access to your accounts
• Any other damages arising from your use of the App

Our total liability shall not exceed the amount you paid for the App, if any.

10. Indemnification

You agree to indemnify and hold harmless SoBoard, its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations
• Any content you submit or share through the App

11. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice, effective immediately.

Upon termination:

• Your right to use the App will cease immediately
• We may delete your account and associated data
• You must cease all use of the App
• Provisions of these Terms that should survive termination will remain in effect

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the updated Terms in the App
• Sending you a notification through the App
• Updating the "Last updated" date

Your continued use of the App after any changes constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where SoBoard is incorporated, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except for claims that may be brought in small claims court.

You and SoBoard agree to waive any right to a jury trial or to participate in a class action lawsuit.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SoBoard regarding the App and supersede all prior agreements and understandings, whether written or oral.
